Supreme Court Nullifies Judgment Dismissing Anyanwu as PDP National Secretary
The Supreme Court has overturned the judgments of both the Court of Appeal and the Federal High Court that resulted in Senator Samuel Anyanwu’s dismissal as the National Secretary of the People’s Democratic Party (PDP).
A five-member panel of the apex court ruled that the question of who serves as the National Secretary of the PDP pertains to the internal affairs of a political party and is therefore not subject to judicial review.
Justice Jamilu Tukur, who delivered the lead judgment, struck down the trial court’s decision issued in October 2024 and also set aside the majority ruling of the Court of Appeal, which had upheld Anyanwu’s dismissal in December.
Justice Tukur affirmed the minority judgment from the appellate court, delivered by Justice Ekanem, which had nullified the trial court’s ruling due to a lack of jurisdiction.
Furthermore, the Supreme Court concluded that the plaintiff, Aniagu Emmanuel, who initiated the lawsuit at the trial court, did not have the legal standing to do so, as he failed to demonstrate how he was affected by the designation of the National Secretary of the PDP. Read More
